These Terms of Service ("Terms") govern your access to and use of the website and services provided by NXG Consulting ("we," "our," or "us"). By accessing our website at nxgconsulting.com or engaging our services, you agree to be bound by these Terms.
1. Services
NXG Consulting provides paid media management services, including but not limited to: campaign management on Meta (Facebook/Instagram), Google Ads, TikTok, Pinterest, and Bing; performance forecasting; creative strategy; and growth consulting for direct-to-consumer brands.
2. Client Engagements
Formal client engagements are governed by separate service agreements that outline scope, fees, and specific terms. These Terms of Service apply generally to all interactions with our website and business.
3. Account Access and Authorization
When clients grant us access to advertising platform accounts (including Meta Business Manager, Google Ads, and other platforms), they represent that they have the authority to grant such access. We will use account access solely for the purposes outlined in our service agreement and in compliance with each platform's terms of service.
4. Data Handling
Our handling of client data and personal information is governed by our Privacy Policy. By engaging our services, clients consent to the data practices described therein.
5. Intellectual Property
All content on this website, including text, design, graphics, and code, is the property of NXG Consulting and is protected by applicable intellectual property laws. Campaign strategies, reports, and deliverables created during client engagements are subject to the terms of the applicable service agreement.
6. Confidentiality
We treat all client business information, campaign data, and financial metrics as confidential. We will not disclose client information to third parties except as required to deliver our services, with client authorization, or as required by law.
7. Limitation of Liability
NXG Consulting provides paid media management services on a best-efforts basis. While we work diligently to optimize campaign performance, we cannot guarantee specific results, including but not limited to: return on ad spend, revenue targets, or conversion rates. Advertising performance is influenced by many factors beyond our control, including platform algorithms, market conditions, and competitive dynamics.
To the maximum extent permitted by law, NXG Consulting shall not be liable for indirect, incidental, consequential, or punitive damages arising from or related to our services.
8. Platform Compliance
We manage advertising campaigns in compliance with the terms of service and advertising policies of all platforms we operate on, including:
- Meta Advertising Policies
- Google Ads Policies
- All applicable advertising regulations and industry standards
9. Termination
Either party may terminate a service engagement as outlined in the applicable service agreement. Upon termination, we will provide reasonable transition support and return or delete client data as requested.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to active clients. Continued use of our website or services constitutes acceptance of updated Terms.
